The Mobile Voting Project’s Texting Terms of Service

1. Overview
The Mobile Voting Project (“Mobile Voting Project,” “we,” “our,” or “us”) offers mobile messaging programs (the “Messaging Program”) that provide users with informational, civic engagement, reminder, fundraising, and/or other mobile communications related to voting participation and civic engagement activities.
By opting into the Messaging Program, you agree to these Mobile Messaging Terms & Conditions (“Terms”)
2. Program Description
The Messaging Program may include:
Voting reminders
Election updates
Civic engagement alerts
Volunteer opportunities
Event notifications
Advocacy updates
Donation or fundraising requests
Other informational or promotional communications related to the Mobile Voting Project mission
Message Frequency
Message frequency may vary depending on:
User activity
Election cycles
Geographic location
Program participation
Alerts or campaign activity
We anticipate there will be no more than 4 texts per month.
Automated Technology Disclosure
Messages may be sent using an automatic telephone dialing system or other automated technology.
3. Consent to Receive Messages
By opting into the Messaging Program, you expressly consent to receive recurring automated text messages from or on behalf of Mobile Voting Project at the mobile phone number you provided.
Consent may be obtained by:
Texting a keyword to a designated short code or phone number
Completing an online form
Checking an opt-in box
Registering for Mobile Voting Project communications
Other affirmative consent methods
You understand that:
Consent is not required as a condition of any purchase, donation, or participation.
Your consent applies even if your number is registered on any state or federal Do Not Call list.
You are responsible for notifying us if your mobile number changes.

4. Eligibility
You must:
Be a resident of the United States
Own or be authorized to use the mobile device associated with the enrolled number
The Messaging Program may not be available in all areas or supported by all carriers.
5. Participating Carriers
Participating carriers may include:
AT&T
Verizon Wireless
T-Mobile
Sprint
U.S. Cellular
Other participating carriers
Not all mobile devices or handsets may be supported, and our messages may not be deliverable in all areas.
Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages.
6. Message & Data Rates
Message and data rates may apply to any messages sent to you from us and to us from you. Charges are billed and payable to your mobile service provider.
Please contact your wireless provider for information about your messaging or data plan.
7. Opt-Out Instructions
You may opt out of the Messaging Program at any time.
To stop receiving messages, reply:
STOP
After opting out, you may receive one additional confirmation message confirming your removal from the program.
Rejoining
To rejoin the Messaging Program after opting out, you must complete the opt-in process again.

9. Privacy
Your privacy is important to us.

Mobile phone numbers

Provide support
Conduct analytics
Comply with legal obligations
We do not sell your mobile phone number or SMS consent information to third parties for their marketing purposes.

10. User Responsibilities
You agree:
To provide accurate and current information
Not to use the Messaging Program unlawfully
Not to interfere with the operation of the Messaging Program
To notify us promptly if your phone number changes
11. Service Availability
The Messaging Program is provided on an “as-is” and “as-available” basis.
We do not guarantee:
Message delivery
Message accuracy
Uninterrupted service
Availability at all times
Delivery may be delayed or impacted by:
Carrier outages
Network conditions
Device limitations
Government restrictions
Technical failures
12. Limitation of Liability
To the fullest extent permitted by law, Mobile Voting Project and its affiliates, officers, employees, contractors, partners, and agents shall not be liable for:
Delayed or undelivered messages
Errors in message content
Interruptions in service
Unauthorized access
Technical failures
Indirect, incidental, special, consequential, or punitive damages
Your sole remedy for dissatisfaction with the Messaging Program is to stop using it and opt out.
13. Indemnification
You agree to defend, indemnify, and hold harmless Mobile Voting Project, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of any third party claim, demand or action arising out of (i) your failure to notify us of a change in the information you have provided, including any claim or liability under the Federal Telephone Consumer Protection Act, 47 U.S.C. § 227, et seq., or similar state and federal laws, and any regulations promulgated thereunder, which damages result from us attempting to contact you at the mobile telephone number you provided to us, including but not limited to your provision of a telephone number that is not owned by you and/or your failure to notify us of any changes to your telephone number;(ii) your breach of these Terms; (iii) your violation of the law or any third-party right; or (iv) any activity otherwise related to your participation in mobile texting (including your negligent or wrongful conduct).
14. Changes to the Messaging Program or Terms
We reserve the right to:
Modify these Terms
Suspend or terminate the Messaging Program
Change message frequency
Change short codes, phone numbers, or keywords
Changes become effective upon posting updated Terms or otherwise communicating the changes to users.
Continued participation after changes constitutes acceptance of the revised Terms.
15. Compliance with Law
The Messaging Program is intended to comply with applicable laws, including:
The Telephone Consumer Protection Act (TCPA)
CAN-SPAM Act (where applicable)
CTIA Messaging Principles & Best Practices
Applicable state privacy and consumer protection laws
16. Governing Law
All matters relating to these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to these Terms shall be instituted exclusively in the Federal courts of the United States or the courts of the State of New York, in each case located in New York, NY, and you irrevocably submit to the exclusive jurisdiction of such courts in any such suit, action or proceeding.
17. Arbitration; Waiver of Class Action; WAIVER OF JURY TRIAL
PLEASE READ THIS SECTION CAREFULLY, AS IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. IT CONTAINS PROCEDURES FOR A BINDING ARBITRATION, A JURY TRIAL WAIVER, AND A CLASS ACTION WAIVER.
Arbitration
Mobile Voting Project Media reserves the right to invoke the jurisdiction of any competent court to remedy or prevent violation of these Terms, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, termination, or to otherwise protect our interest. Any dispute with you in connection with these Terms may, at Mobile Voting Project’s sole discretion, be resolved through binding arbitration in the State of New York, pursuant to the commercial arbitration rules of the American Arbitration Association (“Arbitration”) applying New York law. Absent Mobile Voting Project’s express written authorization, in the exercise of its sole discretion, in favor of a judicial forum for dispute resolution, your only forum is Arbitration. The results of Arbitration shall be final, binding and non-appealable, except as allowed by law.
Waiver of Class Action
YOU AND MOBILE VOTING PROJECT EACH HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE THE RIGHT TO PARTICIPATE IN A CLASS OR COLLECTIVE ACTION AGAINST THE OTHER IN ANY DISPUTE OR PROCEEDING (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY). ALL CLAIMS MUST BE BROUGHT SOLELY IN YOUR OR OUR INDIVIDUAL CAPACITIES, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.
Waiver of Jury Trial
YOU AND MOBILE VOTING PROJECT EACH HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVE, TO THE EXTENT PERMITTED BY APPLICABLE LAW, TRIAL BY JURY IN ANY LEGAL ACTION OR PROCEEDING RELATING THESE TERMS, THE TEXT MESSAGING PROGRAM, AND/OR FOR ANY COUNTERCLAIM.
